St. Louis, MO: This morning the Supreme Court released two great decisions that are victories for the American people.
First, the court voted in National Institute of Family and Life Advocates v. Becerra to strike down the "California Reproductive FACT Act," which required pregnancy resource centers to promote abortion providers as an alternative service. Justice Clarence Thomas, writing for the majority, said this law "likely violates the First Amendment… The licensed notice is a content-based regulation. By compelling petitioners to speak a particular message, it 'alters the content of [their] speech.'"
Second, the High Court – yet again – upheld Trump's so-called "travel ban" on a few select nations associated with terrorist organizations or failing governments that prevent comprehensive background checks. Chief Justice John Roberts sent a strong message in his writing for the majority – "The Proclamation is squarely within the scope of Presidential authority." The majority decision goes on to reiterate that the President of the United States has broad powers under immigration law to make policies and act in the interest of national security. The opinion also smacked down the suggestion that campaign statements may be used to legally determine an executive's intent in policy.
"These are two excellent wins for the Constitution, and for freedom and security in America," said Ed Martin, president of Phyllis Schlafly Eagles. "From the right to life and the right to free speech to the safety and security of our nation, the Supreme Court has delivered great interpretation and precedent today.
"Although not their first defense of the President's authority under immigration law, we are happy to see such a strongly worded opinion. We expect this matter to now be laid to rest in the courts. We are also thrilled for the First Amendment defense the Court handed down today for all Californians. Never before this time in our history have we witnessed such blatant and widespread attacks against the First Amendment rights of conscience and speech of our individuals and business owners. Whether bakers, florists, or organizations that want to help expectant mothers – the Supreme Court is racking up big wins this year in defense of the First Amendment."
