The following is a transcript from the Pro America Report with Ed Martin.
Welcome, Welcome, welcome. It’s Ed Martin here on the Pro America Report. Great to be together as always. So much happening in these summer hot summer months, hot summer week. Usually gets quiet. Usually you have some people go on vacation, although because it’s an election year, you got these conventions coming up, so that keeps it a little hopping and popping, but it’s the 4th. of July week. And people will usually settle down. But there’s, oh man. There’s a lot going on.
The Supreme Court, of course, had a final case. The very last case of the year. Which we touched on in the previous program. And that granted and and I don’t think it granted, I think it described presidential immunity as it has existed and has as it has to be understood and I believe it was Senator Mike Lee that had a thread on X. That was the best at describing this. And I will get to that in a moment.

Timothy Hale was one of the January 6 prisoners, perhaps the most egregious case out there, for reasons that you will find out in this interview, it will go for at least an hour. It may go for 90 minutes. I’m not gonna hold it back. I’m gonna go through detail after detail and hear what Timothy Hale has to say. He served more than three years in jail. And all of it. All the length of time was related to the 1512, the law that was thrown out by the Supreme Court, and we’ll hear from him on that.
The rest of it, what he was alleged to have done was misdemeanors, you know, vandalized, vandalized enough, vandal trespass, being in the wrong place, unauthorized entry into a an authorized only Place, those kinds of things. Misdemeanors should have been a fine go home. Instead it was more than three years in jail. Insane that it happened in America. Alright.
First, let me let me get to this and then I wanna. Here’s here’s what you need to know today. Joe Biden’s biggest problem is not named Trump. His biggest problem is not is, the big. The biggest opponent of his life, is not named Trump. I’ll get to it. It’s it’s Kamala that’s that’s the problem. For him to have a life, for his life not to end in real, ignominious failure. He he has a problem that’s named Kamala – will get to that.
But first, let me let me go through this. What Mike Lee said because this is excellent. I I disagree. Even the in the Wall Street Journal, they had a headline, you know, Supreme Court grants presidential immunity. That’s not what happened.
What the Supreme Court did was describe. It didn’t grant anything. The Constitution grants it, and it described and and, you know, codified by its decision what presidential immunity is.
But it was. It was Senator Mike Lee of Utah who had an X thread where he basically disputed one of the Liberals who said, ohh, yeah, the courts out of control. He said no, it’s not. Here’s what’s. In control, here’s what the reason here’s the reason for presidential immunity.
And he went into the fact that there are three branches and that our founders had this way of balancing the power of coequal so-called Coequal branches, the legislative, the courts, the executive, the Presidency, excuse me, the legislative, the Congress, the judicial, the courts and the executive, The Presidency.
And what Mike Lee points out is that you have to have one person in charge of the executive, a President, and that President has to be able to to act and be held responsible politically.
In the judiciary you have you you have no term limits. You have terms for life, but you do have a process to get appointed and there is impeachment possibilities.
In the Congress you are facing election either either six or three years or six or every six years or two years. When the founders started the Constitution, it was actually that the Senate was done by the legislature. Which had a six year term. That’s true the US Senate, but it was you were elected, were selected by a vote of the legislature in the state.
So the point here is, there are checks and balances of the of the legislative branch – elections. And there is removal from office if you misbehave inside the body it could be removed. Very uncommon, but it’s elections, the voters every two years or six years get a chance to to to get their will done.
In the judiciary there’s a check and balance by how you’re appointed. And that a, a judicial decision could be overridden by a law that’s passed by the Congress and signed by the president.
But Mike Lee points out that the the, the federal the executive branch in our coequal Branches has to reside in one person and that one person has to be able to act and so if you think to yourself, well, if I grant you presidential immunity for official acts, isn’t that too much power?
Think about what it would be like if you didn’t have that.
In other words, think about how you have a term limited president. In particular now you have a term limited president again. When the founders did it, there was unlimited, but you have a president and the president. If he did not or she did not have the presidential immunity. You would have a situation where it would be impossible to act.
Everything you would do could be challenged, so you might argue, well, you can’t challenge any act of the president until after his presidency. How does that work? Either you have immunity or you don’t. If you don’t have immunity, then when the President does acts, you could sue him right away. In in his personal capacity, not just officially, they do that.
And more importantly, you would have a situation where you would be second guessing as President all the time all the time. And so the only way to do it the only way it works for our system, as Mike Lee said, the most extraordinary system, our Constitution, the rule of law, our founding values, is to demand. That the President be held accountable by election – he’s in charge. But that he be protected from his official acts. Makes perfect sense. And and as as Joe Biden rants and raves and says how terrible this is, he ought to be thinking of himself. Or he ought. To be thinking of Obama, Obama did official acts, droning some people ended up killing civilians. I think it was killed Americans, and it was, whether it was an error or not. You could be, according to, you know, no man is above the law, including official. Like as President, you could go after him.
You could go. After Joe Biden easily. Easily for saying his official acts to allow the border open are acts of treason. Violations of the law unless it’s protected. He should want that. Joe Biden should want that protection.
And more importantly, as Mike Lee points out, the system needs it. The system needs that Protection that that doctrine to work well.
Alright, let me finish up with my point that I started to make earlier. The, Joe Biden is now losing to Donald Trump in every measurable race. I you know, every poll. I mean, every poll that’s coming out. We mean the reason we haven’t heard a big poll is because it’s probably even worse and those will be coming soon. It’s gonna be brutal and the media has turned on him finally. And the media is now discredited, widely discredited. Widely discredited for having covered up, it’s not the same as when they were covering up for FDR’s wheelchair or even JFK’s affairs, although those are similar I guess, you know the argument that – in a few minutes we’ll talk with Lee Habib has made to me, is that. That the media is always covering for people don’t don’t get don’t get too dramatic. It’s only in the last. In fact, he makes the arguments only in the last 30 or 40, 50 years where the media tried to say it was even handed, it used to be. We picked a side. The media picked a side too and. They they represented their side, but be that as it may.
The media is widely discredited now for how they covered up for Joe Biden how bad it is, how bad it was, how bad it is. But Joe Biden’s problem is not Donald Trump.
Because now he’s got a problem in his own party. On one level, the problem is that Kamala Harris, nobody wants her to run. But a bigger problem is that they cannot let her get bypassed.
And so if, say, he decides he’s not going to run, he has to say Kamala is the right one, right? And he can’t do that. He he’s he’s hemmed in by Kamala Harris. And if you think that you can get away with inserting into this presidential race. A A replacement like Gretchen Whitmer from Michigan and step over the African American woman Kamala Harris. I, you got another thing coming. I mean, you want to see black men and black women leave and vote for Trump? Do that. See how that turns out.
So Joe Biden and I, you know, I’m. I’m surprised Tucker Carlson has a forceful post on X where he says, look, it’s over. Joe Biden is getting gonna get out. He’s gonna have to find a way out, they’re not gonna be able to do this.
I did not think that that’s where where I I still don’t believe that’s where it’s going. But it may be that the media has turned on him so badly that they’re covering him in such a way. His four minute speech the other night from a teleprompter and his strange countenance almost orange, like like Trump used to do. So maybe the media is turning on him so badly. As a friend of mine said, texting me, I I do a a radio show every Wednesday morning on the Champaign, Urbana, the ESPN station. There, Stevie J and Johnny and with the three of us talk shop.
And Stevie J said. He’s a pretty insightful guy. He’s the host, Stevie J said. Yeah, now, now the media is gonna suddenly start covering Chinese corruption by Joe Biden. And that’s how you’ll know he’s done. Might be right, might be right.
But in the wings is Kamala. Not a good solution. Not a very good solution. So we’ll have to see what happens and amazing times.
