The following is a transcript from the Pro America Report.
Welcome, Welcome, welcome. It’s Ed Martin here on the Pro America Report and we have got to get to it today what you need. To know a big one. The big one out of Colorado comes news that the Colorado Supreme Court has said as to the primary the Colorado primary. Donald Trump’s name may not appear because he is barred from being on the Colorado. Court. Excuse me? The Colorado State ballot, because the Colorado State Supreme Court says that the federal constitution bars him from being there under the 14th amendment.
This is nonsense. This is nonsensical, and the court, which is made up of, made-up of seven members. Excuse it. Seven or nine. Is it 7 or 9? But whatever it is, it was a a split decision and the and the and the court made-up of all Democrats was not was split and a bunch of the Democrats said, you know you you can’t do this. And unfortunately, they were outvoted. I think it was four to three. I’ll have to make sure I apologize. And and there’s a lot of attention on the schools that they came from. Both. Yeah, 4 to 3. So there’s seven members of the Colorado Supreme Court. By a four to three margin, they split and three of them said you can’t do this. That’s not our job. You’re not supposed to do it, the four said. We don’t care. We’re doing it anyway. We’re going against the Constitution. We’re gonna make law. We’re gonna be the ones in charge. We’re gonna be the heroes. We’re gonna be political operatives.
And but they’re not even that confident. So what they did was at the end. Of it, they said. Yeah, we mean it. But we’re going to stay it. In other words, we’re gonna let the Supreme Court US Supreme Court get to it. So we’re not gonna actually make it. A valid at All. We’re gonna make it invalid until the. Supreme Court rules, which they will have to do. But here’s what you need to know.
There has been lots of analysis about how bad the decision is. You know you’re basically relying on the Colorado Supreme Court saying that they think Donald Trump was part of an insurrection. That he is an insurrectionist. You have the Colorado Supreme Court saying in the opinion, stating in the opinion that when Donald Trump said, you know, please proceed peacefully. He didn’t really mean it. All that stuff’s been Covered who these people are and all. What I want to tell you is this. What you need to know is this.
The degradation of our legal system now. We we’re reaching, not just A new low. We’re reaching a totally Different point and the point is, is, is, is, is where. There’s not enough people there. There are not enough people who are are actually going to hold us, hold the situation and make sure that people. In the law are doing the right things. They’re just gonna let anything go. And by that I mean it. It used to be that there was pressure, positive peer pressure from being a part of the legal community. That would hold. You from doing crazy things if you did crazy things outside the box, you would be sort of ostracized. Not sort of. You would be ostracized.
And so in this case for example. It’s such not just political activism, it’s just bad law and bad lawyering. And yet, there’s too much way too much silence. Among the legal profession. So what does that mean? Well, the problem is, what it means is this. Yes,
Our America is not based on one lineage. I mean, there are people that came over in the Mayflower. There are people that came over to Jamestown. There are people that were in this or that family that came here there. It’s not based on wealth only. There are families that were wealthy, the Rockefellers or whatever you could pick. And but none of those things are the divining care, defining characteristics of America.
There’s no crown that’s passed down from King to King. There’s no lineage that’s cited. None of that matters. What matters in America. Well, and so our capitalist free market system, that’s true. But what does that rely on? Well, that actually relies and very importantly and all of it relies our property rights. Our freedoms, our ability to communicate, to create patent rights, copyrights, they say, copyrights, all these things rely on what? The Constitution and the rule of law. And a set of values that respect those. That’s important. It’s Christian in its origins. It’s Judeo-Christian in its larger scale origins, if you want, but it’s a it’s a notion that truth and honor and justice matter, that the human person is worthy of respect, etcetera. And you could see in our founding documents, fundamentally and especially in the Constitution, we hold these truths to be self-evident. All men are created equal. And unalienable rights? Life, Liberty, pursuit of happiness. Structures that limit power that protect majorities, protect minorities from majorities. The tyranny of the majority. All these things are present in our in our Constitution, our rule of law and our founding documents. And therefore. And our and our values that knit us together. That’s what is America’s greatness. What we’re seeing right now. Is the assault. At the very core, it’s an assault on the very core. Of America. On the very core of who we are. Of what we’re about. And it’s not simply lawfare. Now it’s lawfare. It’s occurring. It’s, you know, weapon. Excuse me. Weaponization of of of government against people, all those things.
But now the system is breaking down. The system that had as part of its self policing mechanism a class of people, not a ruling class, not a special class in terms of status or wealth automatically, although some certainly you did have more status if you were a lawyer, you did generally have more wealth if you worked. But none of those things. Were automatic based on being a member Of the bar. But they were there was a value in it. There was a sense in it.
And you can say, well, when when did this start? You gonna you wanna criticize the the legal system? Did it get? Did it get more complicated when they started law schools, you know, before 1960 or 1963 or whenever you didn’t go to law school for three years you went to study pre law and then you went to work for lawyers and you it was sort of a different field to go into than This idea of Graduate School and then maybe that’s what caused it. Lots of money spent on Graduate School. Classes of people who are law professors.
Is it when the administrative state grew and so we needed more lawyers and we ended up with administrative lawyers, administrative law judges, bureaucrat bureaucratic judges.
There’s a famous speech at the late Chief Justice Rehnquist gave, and Russia and the Soviet Union at the time, I think where he said in the. Soviet Union you have to pick. You need to be a practicing lawyer. You know, like we know it or be in the bureaucratic class, the sort of magistrate class judges and and and arbiters of, of decision making. And he said we don’t want that. We’re America. Our system is based on broadly, on these lawyers, being a part of it, not specialized Class. It changed. Whatever is it. Was it when the plaintiffs bar figured out that you could get, you could extract large payments from from either the government or from insurance companies, from individuals by by sort of manipulating the system. Is that what it was? Is it when the Criminal Code and Joe Biden used it to penalize Drug dealers in a way that was, you know, looking back more draconian than effective.
Whatever it is, here we are. And they’re not just messing with jury verdicts and not just messing with. I hate to say it with people’s lives, putting them in jail for long times, long periods of time. No.
Now they’re messing with the actual structure of America. The American Republic putting people. Putting the system and the the the vote of the people. Into a a a measurement into a into a decision making a setup because they know better that there are people in Colorado, four members of the Colorado Supreme Court that Facts be damned, law be damned, we’re going to come up with this decision because we want to further that truth. And we’re just going to do it.
And it’s an extraordinary moment in history, in the history of America, in the history of of Western, the Western World, nation states. It’s what you need to know is it’s a dangerous time. It’s a dangerous time and you know when when RFK Junior says, for example, that if they if they try to keep the people from voting for the candidate they want in this. case Trump that. America would become, he said, ungovernable, ungovernable. That’s what he said. RFK junior. It’s a knife’s edge.
And I have to say of all the things about it that make me disturbed. The most disturbing is the silence of the lawyers. The silence of the lawyers. That the legal community is not Rising up to say. No, no, no. We’re not going to tolerate this. It doesn’t feel like they understand the moment we’re in or to say it differently, it feels like that if they do understand, it’s because they’re holding back because they’re afraid of what’s happened. They’re afraid of what they’ve seen. They’re afraid of what could happen. They’re afraid of what Could be done. It is truly, truly a threat to the future of our Republic. That’s what you need to know. That’s what you need To know.
