Court Could Be Poised to Smack Down DOJ Persecution Against Hundreds
Washington, D.C.: The Supreme Court today granted petition to an appeal from Joseph Wayne Fischer, a January 6 defendant who is challenging the DOJ’s use of one of the most widely charged felonies against J6 patriots and marchers.
“The Department of Justice figured out how to put a unique spin on the law so they could prosecute hundreds of January 6 prisoners with felony charges on obstruction of an official proceeding,” said Ed Martin, president of Phyllis Schlafly Eagles. “The DOJ has made sure that more than 300 defendants who ought to have faced misdemeanor charges on trespass behavior are now facing down up to 20-year sentences over felony obstruction.”
“This is a grave abuse of their prosecutorial power,” Martin continued. “It’s high time the High Court doles out a severe check and balance against the abusive Executive Branch. If they grant relief against these trumped-up charges, they could change the lives of nearly 330 defendants who have been unjustly persecuted. I hope and pray that Mr. Fischer’s appeal finds a speedy and correct result.”
