Bruen Decision Paying Out 2nd Amendment Benefits
Washington, D.C.: The Supreme Court this week has already issued a stellar ruling for the Constitution, striking down a Massachusetts gun control law and directing a lower court to consider a case that surrounds it. Morin v. Lyver centers around a patchwork of anti-gun laws that make it next to impossible to effectively use a firearm to defend oneself.
“Massachusetts has a notorious legal framework that makes gun ownership a nightmare,” said Ed Martin, president of Phyllis Schlafly Eagles. “The licensing layers needed to purchase, own, and carry pistols is a maze of red tape and they even go so far as to dole out lifetime bans on the purchase of firearms to anyone convicted of even nonviolent misdemeanors involving guns. State laws are clearly built to choke firearms ownership to death, yet the U.S. District Court of Massachusetts laughably found the law to be constitutional. Thanks to the Supreme Court, however, the First Circuit Court of Appeals is going to have to try again.”
Similar to the overturn of Roe in Dobbs v. Jackson, the High Court used New York State Rifle & Pistol Assc., Inc. v. Bruen to give some major high-level course correction on how gun laws in the U.S. are made. Justice Clarence Thomas, writing for the majority, took the opportunity to remind us of the proper way to historically consider firearms in America.
“The very clear, concise, and excellent language in Bruen has done more than send immediate shockwaves through tyrannical anti-gun states like California and New York,” Martin continued. “It has given fuel to many pending and upcoming gun rights cases. With a new Supreme Court language and precedent, there are about to be a lot of very successful legal challenges at both the state and federal level to burdensome and unconstitutional firearms regulations.
