U.S. District Judge Blocks Vaccine Mandate on Healthcare Workers in 10 States
Washington,D.C.: “This is a huge victory against federal oppression,” said Ed Martin, president of Phyllis Schlafly Eagles. “District Judge Matthew Schelp, based in St. Louis, delivered a well thought preliminary injunction, blocking the Biden administration from unconstitutionally mandating the Covid vaccine for healthcare providers participating in two federal programs.”
Judge Schelp said the Centers for Medicare & Medicaid had no authority from Congress to mandate vaccines to providers participating in their programs. Schelp wrote: “CMS seeks to overtake an area of traditional state authority by imposing an unprecedented demand to federally dictate the private medical decisions of millions of Americans. Such action challenges traditional notions of federalism.”
“Judge Schelp is spot on,” Martin said. “They is a great victory in the face of the ridiculous mantra of the Biden administration that federal rules supersede all state policies. The federal courts are performing their vital check now against such outrageous and tyrannical decisions from the federal executive. This decisions against CMS comes on the heels of the Fifth Circuit Court of Appeals ordering a hold on the vaccine mandate on businesses. Liberty is on the move against executive oppression!”
