Judge Mizelle Rebukes CDC Power Grab As Unlawful
Washington, D.C.: “Public transit providers and travelers alike rejoice as a federal judge has finally struck down the Biden Administration’s mask mandate on mass transit,” said Ed Martin, president of Phyllis Schlafly Eagles. “This rebuke of CDC tyranny is a win for freedom. However, while this is a proper use of checks and balances, we must remember this should never have been such a long-fought battle.
“The Constitution is abundantly clear that Congress makes the laws. The President should not make law and the CDC certainly shouldn’t either. It took a ruling from Trump-appointed Judge Kathryn Mizelle to end this insanity when our liberation from masking by fiat should have come from the legislature. Congress was too scared to do their job, and it’s time Americans helped them find their courage.
