Washington, D.C.: “The GOP-led House took a great step today in voting to prevent males from competing in women’s sports,” said Ed Martin, president of Phyllis Schlafly Eagles. “Make no mistake, though, that this vote should only serve as a first step! While it was certainly the right vote — and it should have been unanimous, as Leader Scalise remarked — this could easily be construed as a show vote. It has no serious chance of passing the Senate or receiving President Biden’s signature.
“The House should build immediately on this vote with their powers of finance and oversight. The Biden Administration has already announced their intention to sign an executive order recognizing transgender athletes under Title IX protections and barring states from banning biological males from competing in women’s sports.
“Sounds like it’s time for the House to pull Department of Education officials in to answer for how this radical shift would be enforced without legislative changes from Congress. Likewise, House committees ought to take a hard look at defunding the DOE and their Office of Civil Rights who are tasked with enforcing Title IX standards — as passed by Congress.
“Congress makes the law. The Executive enforces the law. All of us remember this basic lesson and its catchy accompaniment from the “School House Rock” cartoon. It’s time the House of Representatives to remind the White House and their enforcement agents who makes the law and who doesn’t. Rather than simply passing legislation that’s DOA and siting back on an issue, let’s use the Constitution’s enumerated powers to their full force.”
